Terms & Conditions Health & Beauty Lounge

 

1. General, Scope

  1. These General Terms and Conditions (GTC) apply to all business relationships between Health & Beauty Lounge and our customers.

2. Offers and prices

  1. Our offers are non-binding.
  2. The prices of the treatments and products of the Health & Beauty Lounge are non-binding. Price changes are reserved.
  3. Unless otherwise agreed in individual cases, our current prices apply at the time of conclusion of the contract. When new terms and conditions or offer and price lists appear, all previous ones lose their validity.
  4. All our prices are inclusive VAT.

3. Appointments, treatments

  1. Be treated at your own request and by appointment all legally competent persons from 18 years. For persons under the age of 18, the consent of the legal representative is required.
  2. Agreed dates are binding.
  3. The duration and extent of treatment depend on the previous and individual agreement and the appearance of the skin or the problem to be treated. We give treatment recommendations, the decision on the type of treatment is made by the customer.
  4. If an appointment can not be met by us for reasons beyond our control or force majeure, the customer will be informed immediately, provided that the stored address and contact details enable a timely contact. In this case, we are entitled to postpone the appointment at short notice or to withdraw from the contract. Our statutory rights of withdrawal and termination remain unaffected.
  5. For very short-term online bookings with less than 2 hours lead time, we can not guarantee that we will be able to complete the treatment on the desired date. In this case, the customer will be notified immediately, provided that the stored address and contact details enable a timely contact. In this case, we are entitled to postpone the appointment at short notice or to withdraw from the contract. Our statutory rights of withdrawal and termination remain unaffected.

4. Deadline by the customer

  1. If the customer does not appear on the agreed-upon treatment date and does not cancel this appointment in writing or at least 24 hours in advance, the Health & Beauty Lounge is entitled to invoice the customer for the appointment that has not been canceled on time. with any credits, voucher, offer packages or already paid subscriptions to settle. There is no entitlement to compensation or refund by the customer.
  2. In case of late arrival, there is a right to treatment only during the agreed duration of treatment. Health & Beauty Lounge is also entitled to charge the full treatment time if the treatment time has to be stopped on time due to a subsequent appointment.

5. Payment

  1. Treatments must be paid immediately after the treatment is completed. The same applies to the purchase of products.
  2. Offers, subscriptions and vouchers must be paid in full before the start of treatment. There is no entitlement to conversion / deduction for other treatments or products. A claim for compensation or money back payment in the event of premature termination by the customer or premature termination of treatment by Health & Beauty Lounge, e.g. with repeated offense against the AGBs, does not exist

6. Warranty

  1. Facial and body treatments use well-targeted methods and products by well-trained and trained personnel. A guarantee regarding compatibility and success can not be given. Common temporary side effects that the customer has been notified about on the website, during the treatment interview, and any follow-up questions, at the expense of the customer. There is no right to treatment of side effects, money back or compensation for Health & Beauty Lounge by the customer. This applies in particular if questions were not answered sufficiently or not truthfully in the preliminary talk by the customer. Customers are required to treat diseases that may be affected by the treatment, such as Allergies to point out infections.
  2. The success of treatment is highly dependent on the behavior of the client before, during and after the treatment and other influencing factors. Each skin reacts individually. Therefore, Health & Beauty Lounge does not assume any warranty. Also no guarantees.
  3. Products can only be returned if they show damage. Promotional goods, individually ordered goods or already used goods are excluded from the exchange.

7. Liability

  1. The liability of the Health & Beauty Lounge is limited to gross negligence and intentional acts at the time of treatment.
  2. Claims for damages expire with expiration of 1 day after the contractually agreed termination of the treatment, unless the claims are asserted within this period.
  3. The liability for late effects using the treatment system is excluded, as far as they are not known at the present time. In addition, the liability is excluded if it can not be clearly demonstrated that the consequences of the treatment were incurred.
  4. Insofar as the customer makes false and / or incorrect statements about his physical condition or prior stress when concluding the treatment contract, there is no liability due to the Health & Beauty Lounge. The correctness of the customer information for a successful treatment is absolutely decisive.
  5. If the customer does not or only to a limited extent follow the instructions on any side effects, instructions, recommendations and agreements of the Health & Beauty Lounge that are used for the treatment preparation, the actual treatment or the aftertreatment, the liability of Health & Beauty will be canceled lounge. For further treatment instructions or recommendations after the treatment, which are described in detail on the website in the customer note and / or given orally in the treatment, the liability shall also be void.
  6. Violations gross or repeated violations of the General Terms and Conditions, the company regulations or the instructions of the staff may result in the cessation of a ban or the termination of treatment. There is no claim for reimbursement of the costs and also for no compensation.

8. Changes to the Terms and Conditions

  1. The customer expressly acknowledges that changes to the General Terms and Conditions, the company regulations and the Terms of Use are reserved and that they are brought to their knowledge in a suitable form.
  2. The customer can not derive any rights from a change to the general terms and conditions or the company regulations.

9. Applicable law and jurisdiction.

All legal relationships arising from this contract are subject to Swiss law. Jurisdiction is Zurich.
